Anti Spam Policy
Implix is bound by the following Anti-Spam Policy and agrees to provide this Service in compliance with the provisions stated below. Implix performs its Service also according to the applicable Privacy Policy.
Implix the provider of the GetSubscribers Service, follows a zero tolerance spam policy and avoids sending unsolicited emails in any form while providing the Service. Implix participates in a number of industry initiatives, such as the Email Service Provider Coalition (ESPC) and the Email Sender Accreditation Program (IADB), which promote responsible, permission-based email marketing.
1. Legal Requirements
Implix complies with the following legal requirements established for commercial email service providers: the CAN SPAM Act of 2003, the Directive 2000/31/EC of the European Parliament and Council of 8 June 2000, on legal aspects of information society services, in particular, electronic commerce in the Internal Market ('Directive on Electronic Commerce'), along with the Directive 2002/58/EC of the European Parliament and Council of 12 July 2002, concerning the processing of personal data and the protection of privacy in the electronic communications sector (.Directive on Privacy and Electronic Communications.) and laws in force in the Customers country of residence.
2. How we define Spam
Spam, also known as junk mail, is an unsolicited email message. Spam is commercial email or unsolicited bulk email, including .junk mail., which has not been requested by the recipient. It is intrusive and often irrelevant or offensive, and it wastes valuable resources. Spam messages are the opposite of permission-based email, which are normally anticipated, personal, relevant and/or associated with a pre-existing business or personal relationship. Inappropriate newsgroup activities, consisting of excessive posting of the same materials to several newsgroups, are also deemed to be spam. The term 'spamming' refers to transmitting, distributing or delivering any unwanted e-mail correspondence, especially in mass quantities, through electronic means of communication.
3. Verification, Preventing Spam
Implix has developed its Internet marketing tools to incorporate strict permission-based email rules. This Anti-Spam Policy is implemented through the following:
At GetSubscribers subscribers can be added and commercial correspondence shall be sent. Implix may send emails only to those subscribers who gave their explicit consent to receive commercial email.
Email addresses may also be imported or added to the mailing list manually. In such cases, the subscriber's permission to process their data is required.
Implix does not rent, lease and/or purchase email addresses from a third party, nor do we gather them through surreptitious methods, such as scraping or harvesting. We do not use any automated solutions, software or scripts. We store and manage data, and send electronic information only to those recipients who have expressly agreed to receive such information from you.
4. How we avoid Spam complaints
To help in establishing that we are not participating in activities constituting spam, we ask ourselves the following questions:
- Are emails sent to non-specific addresses?
- Has the transmission path information or originating address been deliberately falsified?
- Are emails sent to mailing lists or distribution lists, which then send indirectly to various other email addresses?
- Have we imported for use a purchased list of any type?
- Does email not provide a fully functioning link to unsubscribe?
- Do we continue to mail anyone who has asked to be deleted from the mailing list?
- Does the email subject line contain false or misleading information?
- Do we use a third party.s email address or domain name without the party.s consent?
5. Content of our Messages
We provide true and accurate information in our email headers and we always clearly identify ourselves as the email sender. We explicitly indicate the subject in the subject line of email so it is not deceptive, and thus we prevent misleading the subscriber about the purpose and content of the message.
6. Postal Address
We provide our true and accurate postal address in each message footer. We maintain and promptly update this data to ensure it is current, complete and accurate. Implix actively monitors all outgoing messages to verify that the appropriate sender's information is included in the message content.
7. Removals
Each message sent from an Implix account contains an unsubscribe link that cannot be removed. The link automatically updates the mailing list to ensure that a subscriber that has opted out will not be sent any further mailings.
Agreement Violations
Implix does not use the Service to send any unsolicited and unwanted e-mail correspondence. Neither the implix.com, getresponse.com and getsubscribers.com email address, nor the URL may be included in a bulk message or in a bulk-advertised web page.
